Luggage Storage Service Terms and Conditions

Preamble

The Customer who deposits luggage and/or uses the optional transport service (where available) for said luggage enters into a contract with:

Hereinafter referred to as the "CONTRACTING PARTY".

The Customer declares to have read and accepted these General Terms and Conditions of Contract (hereinafter "General Terms and Conditions" or "Regulations"). Visitors and Users who refuse to accept the Regulations will not be able to book and/or purchase the services.

Definitions

Luggage

Each individual container or item handed in separately by the Customer, including for example: suitcase, trolley, backpack, bag, duffel bag, sack, box, hard-shell container.

Important: Each container/item constitutes a separate piece of luggage. E.g.: 1 suitcase + 1 backpack = 2 pieces of luggage.

Customer

The depositing party who entrusts luggage for safekeeping at one of the luggage storage locations, also referred to as Boxes, for a limited period of time.

Optional Transport Service

Upon the Customer's request and subject to the CONTRACTING PARTY's availability: (a) pick-up service from the Customer's specified address, (b) delivery service upon completion of the storage period, (c) transfer service between different storage locations. All optional services are subject to an additional charge.

Service Regulations

The luggage storage service consists of the Customer entrusting a piece of luggage or movable item to the CONTRACTING PARTY for safekeeping for a limited period of time.

Definition of luggage: "Luggage" means each individual container or item handed in separately by the Customer. By way of example and without limitation: 1 suitcase, 1 trolley, 1 backpack, 1 bag, 1 duffel bag, 1 sack, 1 box are each considered separate pieces of luggage.

Size and weight limits per piece of luggage:

  • Maximum weight: 32 kg per piece of luggage
  • Maximum dimensions: sum of height + width + depth not exceeding 158 linear cm (approximate equivalent: 80cm x 60cm x 60cm)

The Customer is strictly prohibited from bringing the following items into the luggage storage facility:

  • Flammable materials: flammable liquids, compressed gases, explosive substances
  • Perishable goods: fresh food, food products without adequate preservation
  • Liquids: unsealed beverages, oils, or chemical products
  • Items prohibited by law: any item whose possession is illegal
  • Hazardous items: articles that by nature or packaging could cause harm to people, the environment, or other luggage
  • Plants and animals: living beings of any kind
  • Waste: refuse of any kind
  • Weapons: firearms, bladed weapons, blunt instruments
  • Dangerous goods: items capable of causing physical harm to property, people, or animals
  • Medications and controlled substances: unprescribed drugs, narcotics, psychotropic substances

The Customer declares under his/her own responsibility that the baggage does not contain flammable, explosive, corrosive, toxic, pressurized or otherwise dangerous substances.

By entrusting luggage for storage, the Customer declares to be solely responsible for its contents and holds harmless the CONTRACTING PARTY from any direct or indirect damages to themselves or third parties that may be caused by the luggage or its contents and/or any item left in storage or transported.

The Customer acknowledges and accepts the CONTRACTING PARTY's right to inspect the contents of any item entrusted for storage, as well as to refuse, at its sole discretion, the storage of items deemed hazardous and/or excessively large and/or of high monetary value.

The Customer is informed and accepts that luggage left in storage with the CONTRACTING PARTY may be inspected by competent authorities (State Police, Carabinieri, Guardia di Finanza, and other Public Safety authorities) at any time and without prior notice.

The CONTRACTING PARTY will take the utmost care of all items stored and/or transported, but shall not be held liable for any direct or indirect damages that may result from the storage and/or transport of the luggage and/or items entrusted by the Customer, except in cases of damages caused intentionally or through gross negligence on the part of the CONTRACTING PARTY.

Luggage deposited by the Customer may not have a total value exceeding 200 euros, including its contents.

The CONTRACTING PARTY's liability for damages to the Customer or third parties is excluded in all circumstances, except in cases of willful misconduct or gross negligence established by a court of law.

In any case, and notwithstanding the foregoing, the CONTRACTING PARTY's liability is limited to a maximum of 200 euros per piece of luggage (including contents) and/or stored item. This cap is absolute and constitutes the financial limit of any reimbursement or compensation.

Prices for the use of the storage facility and the optional transport service vary based on the number of pieces of luggage and the duration of storage. Updated rates are available on the website mitucasa.com and are communicated to the Customer before confirmation of the service.

Accepted payment methods:

  • Cash at the storage location
  • Credit/debit card (Visa, Mastercard, American Express)
  • Online prepayment via the MiTuCasa.com website

Cancellation policy:

  • Free cancellation up to 24 hours before the scheduled storage time
  • Cancellations within 24 hours: 50% refund of the amount paid
  • No-show without prior notice: no refund

Refunds: Any refunds will be processed within 14 business days of the cancellation request and credited to the original payment method used by the Customer.

At the time of luggage drop-off, the Customer is required to provide:

  • A valid government-issued photo ID (national ID card, passport, driver's license)
  • An active phone number for urgent communications
  • The expected date and time of pick-up

In the absence of these items, the CONTRACTING PARTY will not be able to accept the luggage for security reasons and compliance with Public Safety regulations.

Access hours: The luggage storage and pick-up service is available during the opening hours published on the website mitucasa.com in the contact section and confirmed at the time of booking.

Drop-off procedure:

  1. Present a valid identity document.
  2. Complete the acceptance form indicating the luggage items being deposited.
  3. The Customer must inform the staff of any fragile, delicate items or items requiring special care during handling, storage or transport.
  4. Visual inspection of the external condition of the luggage. The CONTRACTING COMPANY also reserves the right to request inspection of the contents in the cases provided for under these Terms and Conditions.
  5. Photographic documentation of the external condition of the luggage, including, where appropriate, photographs of the front, back, sides and visible details such as scratches, dents, breakages, defects to wheels, handles, zippers or any other pre-existing damage or irregularities.
  6. An identification tag will be attached to each item of luggage.
  7. A receipt containing a unique storage code will be issued.

Pick-up procedure:

  1. Present the storage receipt and a valid identity document.
  2. Verification of the identification details.
  3. Inspection of the external condition of the luggage in the presence of the Customer and, where available, comparison with the photographic documentation taken at the time of drop-off.
  4. Where appropriate, new photographic documentation of the condition of the luggage at the time of return.
  5. The Customer must immediately report any externally visible damage that they believe was not present at the time of drop-off, so that it can be inspected and documented.
  6. Return of the copy of the identity document, where retained.
  7. Signature confirming receipt of the returned luggage.

The CONTRACTING COMPANY offers, upon request and subject to availability, the following additional transport services:

A) On-site Pick-up

The Customer may request the collection of luggage from the address indicated by them (hotel, apartment, B&B, other accommodation), providing the following information:

  • Full pick-up address, including street number, floor and apartment number
  • Preferred pick-up time slot (subject to availability)
  • Active telephone number for coordinating the pick-up
  • Number and type of luggage items to be collected
B) On-site Delivery

At the end of the storage period, the Customer may request delivery of the luggage to the address indicated by them, providing the same information required for pick-up.

C) Transfer Between Storage Locations

The Customer may request the transfer of luggage from one MiTuCasa storage location to another MiTuCasa storage location within the service area.

Additional Service Fees

On-site pick-up/delivery services and transfers between storage locations are subject to additional fees, which may vary depending on the following factors:

  • Distance from the nearest MiTuCasa storage location
  • Number of luggage items to be transported
  • Weight and dimensions of the luggage
  • Availability of a lift/elevator in the building
  • Urgency of the requested service

Current rates are available on the website mitucasa.com and will be communicated to the Customer before confirmation of the service.

Liability During Transport

During the pick-up, transport and delivery of luggage:

  • The CONTRACTING COMPANY will take all necessary precautions to safeguard the integrity of the luggage
  • The Customer is required to check the condition of the luggage at the time of delivery/pick-up
  • Any visible damage must be reported immediately to the operator and recorded in the transport document
  • The same liability limits set out in Articles 7, 8 and 9 of this Agreement shall apply (maximum value of EUR 200 per item of luggage)
Operating Procedure for On-site Pick-up
  1. Book the service at least 24 hours in advance via the website or email
  2. Confirmation of the pick-up time slot by MiTuCasa
  3. SMS/phone call from the operator 30 minutes before arrival
  4. Presentation of the Customer's identity document to the operator
  5. Completion of the luggage acceptance form
  6. Issuance of the storage receipt to the Customer
Operating Procedure for On-site Delivery
  1. Request delivery at least 24 hours in advance
  2. Confirmation of the delivery time slot
  3. SMS/phone call from the operator 30 minutes before delivery
  4. Verification of the recipient's identity by means of an identity document
  5. Inspection of the condition of the luggage in the presence of the Customer
  6. Signature confirming delivery
  7. Return of the storage receipt and copy of the identity document
Customer No-show

If the Customer is not present at the specified address during the agreed pick-up or delivery time slot:

  • The operator will wait for a maximum of 15 minutes
  • At least 2 attempts will be made to contact the Customer by telephone
  • If no response is received, the service will be considered unsuccessful
  • The transport service fee will nevertheless remain payable
  • A new appointment may be arranged subject to an additional charge

The Customer agrees to provide their personal details and authorizes the storage staff responsible for processing the booking to make a copy of the provided identity document, solely for the purpose of completing the requested service.

This copy will be attached to the luggage intake record at the storage facility and will subsequently be returned to the Customer together with their luggage at the time of pick-up.

The collection and processing of provided personal data will be carried out in compliance with the legislative and regulatory provisions on personal data protection, including:

  • Reg. UE n. 679/2016 (GDPR) - General Data Protection Regulation
  • D.Lgs. n. 101/2018 - Italian implementing legislation
  • D.Lgs. n. 196/2003 - Italian Personal Data Protection Code (as amended)

The provided personal data will be processed using manual and automated tools exclusively by the CONTRACTING PARTY and/or external professionals/consultants for the purposes of:

  • Fulfillment of legal obligations (registration with competent authorities)
  • Protection and exercise of contractual rights
  • Performance of the luggage storage service

Data Controller: CONTRACTING PARTY - MiTuCasa, Via Castel d'Aiano, 00127 Rome. Data will not be shared with third parties without the Customer's explicit consent.

In the case of long-term luggage storage, the CONTRACTING PARTY may, based on its internal operational needs, transfer the luggage and temporarily store it at one of its other facilities, guaranteeing the luggage's presence at the original drop-off location by the date and time indicated by the Customer for pick-up.

Any Customer need to collect luggage earlier or later than the agreed terms must be notified via email to: [email protected] with at least 24 hours' notice.

In the event of a lost receipt, the Customer must provide their identity document to the storage staff in order to verify the match with the accepted luggage record on file.

In the event the Customer fails to collect their luggage by the agreed date, or has not expressly requested an extension of the storage period:

  1. The CONTRACTING PARTY will store the luggage and/or deposited items for a further 7 days
  2. The applicable daily rate will be charged for each additional day of storage
  3. After 7 days, the luggage will be considered abandoned
  4. Abandoned luggage will be disposed of, with all related costs charged to the depositing party

In the event of theft, loss or damage to luggage left in custody and/or transported, the Customer may submit a specific claim using a paper or electronic form provided by MiTuCasa.

  • The form may be completed in the presence of MiTuCasa staff or submitted electronically according to the methods communicated by MiTuCasa.
  • The claim and related documentation may be sent to [email protected].
  • Where available, the claim must be accompanied by photographs suitable to document the theft, loss or damage.
  • The booking number or another reference useful for identifying the deposit and the luggage concerned must be indicated.
  • In the event of a financial claim, the Customer must provide documentation useful for assessing the damage, such as a repair estimate and/or documentary proof of the value of the luggage.
  • The maximum amount that may be recognised remains subject to the liability limits set out in Articles 7, 8 and 9 of this Contract and, in any event, to a maximum of EUR 200 per individual item of luggage.

The CONTRACTING PARTY is not liable for any missed flights, trains, or other means of transportation, appointments, or any other opportunities of any kind caused by delays in returning luggage or any other issue related to the storage service.

The CONTRACTING PARTY shall not be held liable for failure to fulfill its obligations arising from force majeure events, including (by way of example and without limitation):

  • Natural events (earthquakes, floods, landslides)
  • Fire
  • Strikes and public demonstrations
  • Terrorist acts
  • Criminal acts by third parties (theft, robbery, arson)
  • Extended power outages
  • Orders or measures issued by public authorities

And in any case from circumstances beyond the control of the CONTRACTING PARTY and/or in any way attributable to the Customer's own actions.

The CONTRACTING PARTY reserves the right to amend these Terms and Conditions at any time. Amendments will be published on the website mitucasa.com and will take effect from the date of publication. We recommend checking the Terms and Conditions periodically for any updates.

These regulations, as well as the provision of our services, are governed by and construed in accordance with Italian law. Any dispute relating to our services shall be submitted exclusively to the Court of Rome (Italy).

The Customer elects the registered office of the CONTRACTING PARTY as their special domicile and therefore declares their wish to receive all communications and notifications at the following address: Via Castel d'Aiano, 00127 Rome.

The Customer is required to notify the baggage(ies) prior to delivery if they contain computers, glass, ceramics, bottles, electronics, tools, or any other items requiring special care. If the Customer fails to declare such items, MiTuCasa must assume that the baggage is suitable for normal handling.
